Terms of Service

These Terms of Service ("Terms") govern your access to and use of Netted ("Service"), operated by NDM Ventures, LLC, operating as netted.io ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Description of Service

Netted is a subscription software service that aggregates revenue and transaction data from third-party platforms you authorize, calculates net income after platform fees, and displays consolidated financial summaries. Netted does not move, hold, or custody your funds.

2. Eligibility

You must be at least 18 years old and capable of entering into a binding contract to use the Service. By using Netted you represent that you meet these requirements.

3. Account Registration

You agree to provide accurate, current, and complete information when creating an account and to keep that information up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

4. Subscription and Billing

Netted is offered as a paid subscription. Pricing is displayed at checkout and on the pricing page. Subscriptions renew automatically at the end of each billing period unless you cancel before renewal. We process payments through Stripe, Inc. By subscribing, you authorize us to charge your payment method on a recurring basis.

We offer a 14-day free trial for new accounts. Your payment method will not be charged until the trial period ends. You may cancel at any time before the trial expires to avoid being billed.

All fees are in US dollars and are non-refundable except as required by applicable law or as stated in our refund policy.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to gain unauthorized access to the Service or any systems connected to it.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Use the Service to scrape, harvest, or collect data about other users.
• Resell, sublicense, or otherwise transfer access to the Service to third parties.
• Introduce malicious code, viruses, or other harmful components.

6. Third-Party Integrations

The Service connects to third-party platforms (such as Stripe, Gumroad, PayPal, Lemon Squeezy, Etsy, and affiliate networks) via OAuth or API credentials that you provide. You authorize Netted to access data from those platforms solely to deliver the Service. Your use of those third-party platforms is governed by their respective terms of service, not by these Terms.

We are not responsible for the availability, accuracy, or content of data obtained from third-party platforms. Platform APIs can change or become unavailable, and we make no guarantee of uninterrupted access to any connected platform.

7. Data and Privacy

Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the practices described in the Privacy Policy.

8. Intellectual Property

The Service, including its design, software, and content, is owned by NDM Ventures, LLC and protected by copyright and other intellectual property laws. These Terms do not grant you any right, title, or interest in the Service except the limited license to use it as described here.

You retain ownership of your data. By connecting your platforms to Netted, you grant us a limited license to access and process that data solely to operate and improve the Service.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any defects will be corrected.

Financial data displayed in Netted is derived from third-party sources and is for informational purposes only. It does not constitute financial, tax, legal, or accounting advice. You should consult a qualified professional before making financial or tax decisions.

10. Limitation of Liability

To the maximum extent permitted by law, NDM Ventures, LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service, even if advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amounts you paid us in the twelve months preceding the claim, or (b) $50 USD.

11. Indemnification

You agree to indemnify and hold harmless NDM Ventures, LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion, with or without notice. You may cancel your account at any time through account settings. Upon termination, your right to use the Service ceases immediately.

13. Changes to Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top and notify you via email or in-app notice. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Texas.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and NDM Ventures, LLC regarding the Service and supersede all prior agreements and understandings.
